Terms & conditions
1. **Scope, Definitions**
(1) These General Terms and Conditions (hereinafter referred to as "GTC") exclusively apply to the business relationship between us, Christina Sperber Design, Lange Gasse 28, 92237 Sulzbach-Rosenberg, represented by Christina Anna Sperber (hereinafter "we"), and you, the purchaser of our goods (hereinafter "you"), in their valid version at the time of the order.
(2) Goods within the meaning of these GTC are all products available for purchase on the website www.christinaannasperber.com (hereinafter "online shop").
(3) The product offering on our online shop is exclusively for customers who have reached the age of 18.
2. **Order and contract conclusion**
(1) The presentation of goods on our online shop is not a binding offer to conclude a contract but merely an invitation to submit an order by you.
(2) You can select products from our range and collect them in a virtual shopping cart by clicking the "Add to Cart" button. By clicking the "Checkout" button, you submit a binding request to purchase the items in the shopping cart. Before submitting the order, you can change and review the data at any time. The request can be submitted and transmitted by clicking the "Buy" button, thereby accepting the GTC.
(3) If the selected product is not available at the time of ordering, you will be notified at the beginning of the ordering process. In the ordering process, you can only place an offer for the available items.
(4) An automatic order confirmation will be sent to the email address you provided, listing your order and the cancellation policy, which you can print using the "Print" function.
(5) The contract text (comprising the order and GTC) will be provided to you on a durable medium (email or paper print) with the shipping confirmation, at the latest upon delivery of the goods (order confirmation).
(6) If you choose the payment option "Credit Card," the contract is concluded immediately after completing the order process. If you choose the payment option "PayPal," a contract between you and us is concluded when the payment instruction is confirmed. For the payment options "Google Pay," "Sofortüberweisung," "Pay Now with Klarna," or "Installment Purchase with Klarna," the contract is concluded upon receipt of the notification on the date of debiting the account (pre-notification).
(7) The contract text is stored with us in compliance with data protection regulations. If you have a personal customer account, you can access your order data in our online shop under "Login." If you do not have a personal customer account and wish to receive your order data, you can contact us by email (studio@christinaannasperber). We will send you a copy of the stored data for your order. The GTC can be viewed here at any time.
(8) The contract is concluded in the German language.
3. **Presentation on the website**
Slight color deviations of the goods presented in the ANNA THE STUDIO online shop are technically conditioned, and color reproduction depends on your monitor/screen. Therefore, we cannot guarantee accurate color representation; some colors may vary.
4. **Registration for a customer account**
(1) To facilitate the use of the online shop, you have the option to register for a customer account. In this case, you do not need to enter your data with every order. Instead, it is stored in our customer database and automatically inserted into a new order.
(2) For registration, we require the following information: name, first name, address, any different delivery address, and an email address. To protect your data, you also set a password for your account. You enter this data in the corresponding input mask, and with your explicit consent, they are stored in our customer database by confirming the "sign up" button. We use the stored data in accordance with applicable data protection regulations. Details can be found in our privacy policy.
(3) After registration, you will automatically receive an email confirming that your customer account has been set up. Your email address also serves as the username for the customer account. During the registration process, you will be prompted to enter a password of your choice. After logging in to your customer account, you can change this password. Keep your access credentials confidential, do not disclose them to third parties, and protect your access credentials against unauthorized access by third parties. You are responsible for misuse of access credentials and passwords.
5. **Delivery and delivery time**
(1) The goods are shipped as indicated in the product description.
(2) Delivery times specified by us are calculated from the time of contract conclusion. If no different delivery time is indicated for the respective product in our online shop, it is 7-10 working days for delivery within the Federal Republic of Germany and up to 10 working days for delivery to other EU countries.
(3) We are entitled to partial deliveries as far as reasonable for you. No additional shipping costs apply for any subsequent deliveries.
(4) When ordering multiple items with different delivery times, we will ship the goods in one delivery; the delivery time specified for each item is decisive.
6. **Retention of title**
Until the full payment of the purchase price, the delivered goods remain our property.
7. **Prices and shipping costs**
(1) The final prices stated in our online shop include the respective valid legal value-added tax and are subject to additional shipping costs.
(2) The corresponding shipping costs are stated in the order form and are to be borne by you unless you exercise your right of withdrawal.
(3) The goods are shipped by postal service. We bear the shipping risk if you are a consumer.
(4) In case of withdrawal, you are responsible for the direct costs of return shipping.
8. **Payment methods**
(1) Payment can be made via credit card, "PayPal," "Google Pay," "Pay Now with Klarna," "Invoice Purchase with Klarna," "Installment Purchase with Klarna," or "Sofortüberweisung" through our online shop. We accept the credit cards American Express, Mastercard, Maestro, and Visa.
(2) You can change the payment method stored in your user account at any time.
(3) Unless otherwise agreed, the payment of the purchase price is due immediately upon conclusion of the contract.
(4) When selecting the credit card payment method, the purchase price is reserved on your credit card at the time of the order. The actual charge on your credit card account takes place when we ship the goods to you.
(5) When paying with PayPal, you will be redirected to the PayPal website during the ordering process, where you must register or, as an already registered customer, authenticate with your access data and issue or confirm the payment instruction.
(6) In cooperation with Klarna AB (www.klarna.de), Sveavägen 46, Stockholm, Sweden, we offer you the immediate purchase as a payment option. Please note that payment must be made to Klarna. With the Klarna Sofort payment system, you pay by direct transfer method using online banking (PIN/TAN) without registration. We receive real-time confirmation after the transfer is completed.
9. **Vouchers and discount codes**
(1) Vouchers and discount codes can be redeemed as part of an order through our online shop (www.christinaannasperber.com) if this redemption option is explicitly stated on the respective voucher or the discount code has been issued for this purpose. Please enter the corresponding voucher or discount code during the order process. The voucher can only be redeemed within the specified validity period, and the value of the goods must be at least equal to the voucher amount. The discount code can also only be redeemed within the specified validity period.
(2) Multiple discount codes cannot be combined within a single order. Only one discount code can be redeemed per order. The voucher or discount code must be redeemed before completing your order. Retroactive consideration is not possible.
(3) Any remaining balance on vouchers will not be refunded. If you return goods paid in whole or in part with the voucher within your legal right of withdrawal, the value of the goods will be credited to you again as a voucher. No cash payout will be made.
(4) The trading of vouchers is prohibited.
10. **Warranty**
(1) We are liable for material defects according to the applicable statutory provisions, in particular §§ 434 ff. BGB. An additional guarantee exists for the goods we deliver only if explicitly stated in the order confirmation for the respective item.
(2) Commercially customary or technically unavoidable material-related deviations in quality, color, size, equipment, or design of the goods do not constitute a defect.
(3) Warranty rights do not exist for damages caused by misuse or improper use of the goods by you and damages resulting from exposure of the goods to harmful external influences (especially extreme temperatures, humidity, extraordinary physical or electrical stress, voltage fluctuations, lightning, static electricity, fire).
(4) If you are a business, a legal entity under public law, or a public law special fund, you are obligated to examine the goods for quality and quantity deviations with due diligence immediately upon receipt of the goods and to notify us of any obvious defects within days. The same applies to later discovered hidden defects from their discovery. If you violate this obligation to inspect and give notice of defects, the assertion of warranty claims is excluded. The warranty period is one year from the delivery of the goods.
10. **Liability**
(1) We are liable - regardless of the legal basis - for damages or reimbursement of futile expenses in accordance with the following provisions under letter (a) and (b):
(a) In the case of intent and gross negligence, we are liable without limitation. In the case of ordinary negligence, we are only liable for damages resulting from the breach of a material contractual obligation (an obligation, the fulfillment of which enables the proper execution of the contract in the first place and on whose compliance you can regularly rely and trust); in this case, our liability is limited to the replacement of the typical, foreseeable damage.
(b) The liability exclusions and limitations arising from letter (a) do not apply insofar as we have maliciously concealed a defect or assumed a guarantee for the quality of the item, for damages resulting from the violation of life, body, or health, and in the event of liability under the Product Liability Act.
(2) To the extent our liability is excluded or limited, this also applies to the personal liability of our legal representatives and vicarious agents.
11. **Set-off and retention right**
(1) You are only entitled to set-off if your counterclaim has been legally established, is undisputed, or is in a close synallagmatic relationship to our claim.
(2) You can only exercise a right of retention to the extent that your counterclaim is based on the same contractual relationship.
12. **Applicable law**
The law of the Federal Republic of Germany applies to contracts between us and you, excluding the UN Sales Convention and the provisions of international private law. The statutory provisions on the limitation of the choice of law and the applicability of mandatory regulations, in particular of the state in which you have your habitual residence as a consumer, remain unaffected.
13. **Out-of-court online dispute resolution (odr platform)**
(1) The European Commission provides a platform for out-of-court online dispute resolution (ODR platform), which can be accessed at www.ec.europa.eu/consumers/odr.
(2) We are neither obliged nor willing to participate in dispute resolution proceedings.
